Legalissues in counseling
LegalIssues in Counseling
Themental health issues have become increasingly popular today. Notably,it has come to co-relate with other aspects of the society in asignificant way. There have been landmark court cases that haveinvolved patients with mental issues and their therapists. The mostremarkable case was that of Tarasoff who sued the California Board ofRegents. Since then the clinical mental health counseling has beensignificantly impacted by legal decisions. Mental health is stronglyrelated to other social practices that are manifested in thecommunity (Mental health 2015).
Handlingof mental cases requires strict policies that will provide guidanceon how they should be handled. The Tarasoff against California Boardof Regents case acted as an eye opener concerning mental cases andlaw. The incidence exposed the many errors that could be exploitedby law to make the therapist pay for the mistakes that they mightcommit. The main factor that makes this an important factor is thefact that the mentally ill cannot sometimes make informed decisions(Mental health 2015). Since then there have been numerous reformsthat have done regarding the law that are aimed to regulate thesector. For instance, the psychotherapists are obligated to takeliability for whatever damages that might be done by these mentallyill patients. Additionally, the mental health practitioners arerequired to offer protection to the third party (Mental health 2015).This happens when the third party does not know that a person inmentally challenged. In conclusion, the mental health serviceprovision has undergone a lot of legal changes. These changes aremeant to offer protection to third parties. Nevertheless, these lawsare critical because these sector needs to be handled with a lot ofresponsibility.
